SMART COST SEGREGATION AGREEMENT

By checking the box below and submitting your information, you acknowledge and agree to the following:

  1. 1)We, SmartCostSeg LLC, a Rhode Island limited liability company, will prepare a Cost Segregation Study based on the information and documents you provide.
  2. 2)You are responsible for providing accurate information, including settlement documents, property details, and photographs.
  3. 3)This service is intended for qualifying investment properties, generally purchased for less than $1,000,000. Certain property types and transactions, including hotels, nursing homes, major renovations, 1031 exchanges, and large portfolios, are not eligible for this flat-fee service.
  4. 4)We do not prepare tax returns or provide legal advice. Please consult your CPA, tax preparer, or attorney regarding the implementation of the Cost Segregation Study.
  5. 5)We cannot guarantee tax savings or financial results. Actual benefits depend on your specific tax situation.
  6. 6)Our work is based on the information you provide, and we are entitled to rely on its accuracy.
  7. 7)Upon completion, you will receive a professional Cost Segregation Study for review by you and your tax advisor.
  8. 8)The fee is quoted with your study when it is ready to view; no payment is requested before then. An invoice will be issued upon completion, and the final report will be released after payment is received.
  9. 9)When you provide the settlement statement for the purchase of a completed building and we can read it, your study lists the closing costs the buyer paid and adds to the property's basis those that IRS Publication 551 generally includes and that remain included on your confirmed settlement statement. For new construction, closing costs we can read on your settlement statement are listed for your CPA and are not added to the basis, and a renovation study does not add closing costs. Closing costs identified later, and any later change to the land value, are not reflected in the study. Costs added to basis are generally divided between the land and the building in proportion to their relative values, so a change in the land value changes that division. Please discuss these adjustments with your CPA or tax advisor.
  10. 10)Our liability is limited to the fee paid for the Cost Segregation Study.

Consent to Electronic Records and Signatures

What this covers. SmartCostSeg LLC provides its agreements, studies, invoices, notices and other records to you electronically, on this website and by email. Your consent covers every record for your SmartCostSeg account, including every study, agreement and program document connected to it, until you withdraw it. You sign electronically by checking a box, typing your name or selecting a button, and we keep the electronic record of each signature.

Paper copies. You may ask for a paper copy of any record at any time, at no charge. Email team@smartcostseg.com with your name, the record you want and the postal address to send it to.

Withdrawing consent. You may withdraw your consent at any time by emailing team@smartcostseg.com. There is no fee to withdraw. Withdrawing does not undo a signature you have already given or a record already provided. Because the service is delivered online, after you withdraw we cannot start a new study for you online, and we will tell you how we handle any study already under way.

Keeping your email current. We send records and notices to the email address on your account. You can change it at any time in your account settings, or by emailing team@smartcostseg.com.

What you need. A device with an internet connection; a current version of Chrome, Safari, Edge or Firefox with cookies and JavaScript turned on; an email account that can receive our messages; software that opens PDF files; and a printer or storage space if you want to keep copies. If these requirements change in a way that could stop you from opening or keeping a record, we will tell you first, and you may withdraw your consent without any fee.

Your confirmation. By checking the box you confirm that you can open and read this notice on your device, which shows that you can open records in the form we use, and that you consent to receive records and to sign electronically.
