Terms of Service

The rules for using SmartCostSeg.com — written plainly, the way we do everything else.

1. Who we are and what this covers

SmartCostSeg.com (“we,” “us,” the “Service”) provides flat-fee cost segregation studies for investment properties. These Terms of Service govern your use of the website, your account, and the study preparation service. By creating an account or using the Service you agree to these terms and to the Smart Cost Segregation Agreement you accept when you submit a project.

2. The service

We prepare a Cost Segregation Study based on the information and documents you provide through the guided online process: you tell us about your property, upload documentation (settlement statement, photographs, and any inspection or valuation reports), review and accept the agreement, and submit. Most projects are completed within approximately 5 to 7 business days. Certain property types and transactions are routed to our Extended Study service, which carries its own fee quoted before you commit.

3. Pricing

The flat fee for the core service is $999, displayed on the website. There are no sales commissions, no travel expenses, and no needless meetings built into the price. Online payment is not yet enabled — no charges are made through this website at this time, and no payment method is collected or stored. When billing launches, an invoice will be issued upon completion of your study and the final report will be released after payment is received.

4. Your account

You are responsible for your account credentials and for the accuracy of the information you provide, including settlement documents, property details, and photographs. Our work is based on the information you provide, and we are entitled to rely on its accuracy. You may update every profile field, change your email or password, or delete your account at any time from Settings. If you use the Service as a CPA, attorney, agent, or other representative, you confirm you are authorized to act for the property owner.

5. Not tax or legal advice

We do not prepare tax returns or provide legal advice. Please consult your CPA, tax preparer, or attorney regarding the implementation of any Cost Segregation Study. Estimates shown on this site are educational ranges based on the inputs you provide — they are not guarantees, and actual benefits depend on your specific tax situation, including passive-activity rules and state conformity.

6. Deliverables and your Library

Completed studies and related files appear in your account Library. Watermarked draft previews may be provided before final release. Your study is prepared for review by you and your tax advisor; you may share it with them freely. You may not resell or republish the Service itself.

7. Documents you upload

You grant us permission to use the documents and photographs you upload solely to prepare your study and operate the Service. Settlement documents are stored in private, encrypted storage and access is scoped to your account and our preparation staff — see the Privacy Policy for details and retention periods.

8. Refunds and cancellations

If you cancel before analysis of your study begins, you receive a full refund of anything you have paid. Once analysis is underway, fees for work already performed are non-refundable, except at our discretion. If we determine that we cannot complete your study, we refund your payment in full. 9. Limitation of liability

Our liability is limited to the fee paid for the Cost Segregation Study. We are not liable for indirect, incidental, or consequential damages, or for outcomes that depend on your tax situation, your tax preparer’s filings, or information you provided.

10. Termination

You can stop using the Service and delete your account at any time from Settings — account deletion is permanent. We may suspend or close accounts that abuse the Service, upload malicious content, or violate these terms. Executed agreements and completed studies may be retained where the law requires it, as described in the Privacy Policy.

11. Changes to these terms

We may update these terms as the Service evolves (for example, when online payment launches). The “Last updated” date above will change, and material changes will be flagged in the app. Your continued use after a change means you accept the updated terms.
